I. Suspension and Removal of a Domain Name .HN

The RDS-HN may suspend (deactivate) and/or eliminate a Domain Name if:

a. The renewal fee has not been paid in a timely manner.
b. Arbitral Tribunal or judicial authority ordering the suspension and/or disposal.
c. When the Holder has not responded to communication from ccTLD.HN within the required time and report a domain greater than 45 days past due.
d. When the Registrant and/or contacts, and/or the Domain Name information are not updated or are false.
e. The Registrant and/or contacts of the domain name do not comply with the Policies.

1. DISPUTE OF OWNERSHIP OF THE DOMAIN.

a) Any dispute about ownership of a domain name .hn takes place when either a natural or legal person considers a better right to it.
b) The claimant must show the burden of proof according to relevant provisions of this policy, which should not be related to intellectual property issues.
c) Any dispute over ownership of domain names must be claimed by the authorized entity, RDS-HN under the dispute Resolution Policy Regulations published on the site http://www.nic.hn, http://www.ccit.hn/cca.phpd) If this type of dispute is generated and burden of proof exists to substantiate the complaint, the Registrant will proceed to block the domain name in question, so it cannot be modified or transferred during the time of the dispute.

2. FOR INTELLECTUAL PROPERTY DISPUTES

a) Any controversy generated by a violation of intellectual property rights (product trademarks or services, registered commercials, designations of origin, rights reservations) will abide by the Dispute Resolution Policy in respect to domain names under the ccTLD.HN.
b) If there is a clear dispute over intellectual property, the Register will have to proceed to block the domain name so it cannot be modified or transferred during the dispute. Any natural or legal person may assume the right to challenge any request for registration of a domain name .hn when they consider it their right. The properly documented challenge will be requested to the Registrar, who will notify the Administrative contact, so that the parties can settle the dispute by their terms and procedures as they deem appropriate.
c) The Registrar, the Registrant and the Contacts of the domain name disputed are bound to abide by the decision of the arbitration panel to resolve the dispute within a period not exceeding 24 hours.
Any natural or legal person assumes the right to appeal to the Registrar, and bring the complaints to RDS-HN attention if such complaint or claim in connection with the Domain Name, is properly supported.

The following are causes that allow the revocation of a domain name:
• An improper registration, or one that has been made in bad faith
• The loss in the period of registration
• Under the owner of the domain
• Domain in arrears
• By court order or the Arbitral Tribunal
• Policy violation

A domain registrar is considered abusive when three of the following conditions are met:

• That the domain name is identical or similar to a trade or service on an existing copyrighted or trade name of which the claimant is aware.
• That the domain name holder has no rights or legitimate interests in respect to the domain name registered.
• That the domain name was registered and is known to be used in bad faith.

The concurrence of any of the following circumstances without specific wording, will serve to highlight and demonstrate the bad faith of domain assignments.
Circumstances exist indicating that the domain has been registered to sell, lease or transfer of any other form.
That has registered the domain name in order to affect the business of the competition. Anyone using the domain name, using any artifice or deception induces another into error, disappointing it in his own soul.
